Terms of service

These terms are an agreement between your business and Aivanaut, which operates AirQR. Please read them before you sign up — they explain what you can expect from us and what we expect from you.
- AirQR is business software for restaurants. You must be 18 or over and sign up on behalf of a business.
- Every plan starts with a 14-day free trial, no card needed. Prices exclude 18% GST.
- We charge a flat subscription and take zero commission. Money your guests pay goes straight to you.
- Your menus, orders and guest data are yours. Export them anytime; we never sell them.
- You are responsible for what you publish — prices, allergens, taxes and food safety.
1. Accepting these terms
By creating an account, clicking "Create account", or using AirQR, you agree to these terms, our Privacy policy, Refund & cancellation policy and Acceptable use policy. If you accept on behalf of a business, you confirm that you have authority to bind it, and "you" means that business.
If you have signed a separate order form or agreement with us (for example for a Custom plan, Lifetime plan or Source licence), that document takes priority where it differs from these terms.
2. Accounts and eligibility
- AirQR is for business use by restaurants, cafés, bars, cloud kitchens and similar food businesses. It is not a consumer service.
- You must be at least 18 years old and able to enter into a binding contract under Indian law.
- Give accurate sign-up and billing details, including your GSTIN if you want GST invoices, and keep them up to date.
- Keep passwords safe and don't share logins — invite staff with their own accounts instead. You are responsible for everything done under your account and by the staff you invite.
- Tell us straight away at abhishek@aivanaut.com if you suspect unauthorised access.
3. Plans and subscriptions
We offer Starter, Growth and Pro plans, billed monthly or yearly, as described on our pricing page. Yearly plans are charged in advance for 12 months at a discount.
Custom plans (for larger groups), the Lifetime plan and the Source licence are sold through a separate order form that sets out the price, scope, support and — for the Source licence — the licence terms. Those documents form part of your agreement with us.
4. Free trial
Every new account gets a 14-day free trial with access to the features of the plan you choose. No card or payment details are needed to start. We won't charge you automatically when the trial ends — you choose a plan and pay only if you want to continue. One trial per business.
5. Plan limits and fair use
Each plan includes limits — for example the number of outlets, tables, staff logins and AI credits per month — as shown on the pricing page at the time you subscribe. AI credits reset each month and do not carry over. If you reach a limit we'll let you know and you can upgrade; we won't silently charge you for overages.
"Unlimited" features are subject to fair use: normal use by a restaurant business of your size. If usage is far outside that (for example automated bulk traffic), we'll contact you to discuss a suitable plan before taking any action.
6. After the trial, or if a payment fails
If your trial ends without a plan, or a renewal payment fails, you get a 7-day grace period with full access while you sort out payment. After that, your account is restricted: guests can still see your digital menu (read-only, with no ordering or bookings), and you can sign in to view and export your data, but other features are paused until a plan is active.
We do not delete your data because of non-payment. Choose a plan at any time and everything is restored as it was. If you want your account closed and deleted, see section 17.
7. Fees, taxes and renewals
- Prices are shown in Indian rupees (or US dollars for accounts outside India) and exclude GST. For Indian customers we add GST at the applicable rate (currently 18%) and issue a GST-compliant tax invoice. Add your GSTIN before paying to claim input tax credit.
- Customers outside India are responsible for any taxes, duties or withholding in their own country.
- Subscriptions renew automatically at the end of each monthly or yearly period at the then-current price, until you cancel. We'll email you before a yearly renewal.
- We may change prices for future periods. We will give at least 30 days' notice by email, and the new price applies from your next renewal after that notice.
- Upgrades take effect immediately. We credit the unused part of your current plan against the new one, so you pay only the difference.
- Downgrades take effect from your next billing date. If your usage is above the lower plan's limits, you'll need to reduce it (for example, archive tables or remove staff) before the change.
- Refunds are covered by our Refund & cancellation policy.
8. Your responsibilities as a restaurant
You run your restaurant; AirQR is a tool that helps. You are responsible for:
- Accuracy of your menu — dish names, descriptions, photos, prices, portion sizes, and availability.
- Allergen and dietary information — including veg / non-veg / egg marks, allergens and spice levels. Guests rely on it; check it carefully, especially after using AI tools.
- Taxes and billing — correct GST rates, service charges, and compliance with the law on what you charge guests.
- Food safety and licences — holding a valid FSSAI licence or registration (or its equivalent outside India) and any other permits your business needs.
- Your guests' privacy — telling guests how you use their data with your own privacy notice, having a lawful basis to collect it, and answering their requests. We'll help, as explained in our Privacy policy.
- Lawful marketing — sending offers by SMS, WhatsApp or email only to guests who have agreed to receive them, honouring opt-outs, and following TRAI and WhatsApp rules.
- Your staff — who you invite, what access you give them, and removing access when they leave.
9. Acceptable use
You must follow our Acceptable use policy. In short, you must not:
- publish illegal, misleading, infringing or offensive content, or sell items you are not permitted to sell;
- use AirQR to send spam or unsolicited messages;
- scrape, copy or harvest data from AirQR or other restaurants' pages by automated means;
- copy, modify, decompile or reverse engineer AirQR, except to the extent a Source licence you have bought allows it or the law permits it;
- probe, scan or test the security of AirQR without our written permission, or interfere with its operation;
- resell or white-label AirQR to other businesses without a partner agreement.
10. Guest orders and payments
When a guest orders or pays through your AirQR pages, the contract for food and drink is between you and the guest. AirQR is not a party to that transaction, is not a marketplace or aggregator, and does not sell food.
Guest payments — for example by UPI to your own UPI ID, or cash and cards at your counter — go directly to you. We don't collect, hold or settle guest money, and we charge zero commission on your orders. Questions about an order, a refund to a guest, a delivery or food quality are for you to handle with the guest.
11. Intellectual property
Ours
AirQR, including its software, design, templates, themes and the AirQR name and logo, belongs to Aivanaut and its licensors. We give you a limited, non-exclusive, non-transferable right to use AirQR for your business while your subscription is active. Nothing in these terms transfers ownership to you.
Yours
You own your content and data — menus, photos, logos, recipes, prices, orders and guest records. You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, display and process it only as needed to provide and support AirQR for you (for example, to show your menu to guests and generate your reports). That licence ends when your data is deleted. Please upload only content you have the right to use.
Feedback
If you send us suggestions, we may use them to improve AirQR without owing you anything.
12. AI features
AirQR includes AI tools that can import a menu from a photo or PDF, translate it, and draft dish descriptions. AI output can be wrong or incomplete — it may misread prices, miss allergens or invent details. Review everything before you publish it. You are responsible for content you publish, whether or not AI helped create it.
13. Third-party services
AirQR works with services we don't control — for example UPI apps, WhatsApp, printers and payment partners. Your use of them is governed by their own terms. We aren't responsible for their availability or actions, though we'll help where we can.
14. Availability and support
We work hard to keep AirQR fast and available, and we back up your data regularly. However, we don't guarantee that it will be uninterrupted or error-free, and we don't offer a service-level agreement (SLA) except where a Custom plan order form includes one. We may carry out maintenance, preferably outside restaurant peak hours, and will give notice of planned downtime where we can.
Support is by email and phone during business hours (Monday to Saturday, 10:00–19:00 IST), and by WhatsApp for plans that include it. We may add, change or remove features over time; if we remove a major feature you pay for, we'll tell you in advance.
15. Suspension
We may suspend or limit your account, with notice where practical, if you seriously breach these terms or the Acceptable use policy, if your use puts other users or the platform at risk, or if the law requires it. We'll tell you why and restore access once the issue is fixed.
16. Data export and deletion
You can export your menus, orders and guest records as CSV at any time from the dashboard. When you cancel, your account stays readable for 30 days so you can export what you need; after that we delete your data, as described in our Privacy policy. Invoices we issued to you are kept as required by tax law.
17. Cancellation and termination
- You can cancel anytime from the billing settings or by emailing us. Cancellation takes effect at the end of your current billing period, and you keep access until then.
- We may terminate your account for a serious or repeated breach of these terms, or if we stop offering AirQR — in which case we'll give at least 60 days' notice and refund any prepaid fees for the period after termination.
- Sections that by their nature should survive termination (such as fees owed, intellectual property, disclaimers, liability and governing law) survive.
18. Disclaimers
Apart from the promises made in these terms, AirQR is provided "as is" and "as available". To the extent the law allows, we disclaim other warranties, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. AirQR does not give tax, legal or food safety advice; reports and GST summaries are aids, and you should check them with your accountant.
19. Limitation of liability
To the extent the law allows:
- Neither of us is liable for indirect or consequential losses, or for lost profits, revenue, business or goodwill, even if we were told they were possible.
- Our total liability to you for all claims relating to AirQR is limited to the fees you paid us in the 12 months before the event that gave rise to the claim.
- These limits don't apply to liability that can't be limited by law, such as for fraud, or to your obligation to pay fees.
20. Indemnity
You agree to compensate Aivanaut for reasonable losses and costs (including legal fees) arising from third-party claims about your content, your food and service, your dealings with guests, your marketing messages, or your breach of these terms or the law.
21. Governing law and disputes
These terms are governed by the laws of India. Before going to court, please write to us so we can try to resolve the issue in good faith within 30 days. If that fails, the courts having jurisdiction over our registered office will have exclusive jurisdiction.
22. General
- You may not transfer your account to another business without our consent; we may transfer these terms as part of a merger, acquisition or sale of assets.
- Neither of us is responsible for delays caused by events beyond reasonable control, such as power or internet outages, natural disasters or government action.
- If any part of these terms is found unenforceable, the rest stays in effect. Not enforcing a right straight away doesn't mean we give it up.
- These terms, together with the policies they refer to and any order form, are the entire agreement between us about AirQR.
23. Changes to these terms
We may update these terms from time to time. We'll post the new version here with a new date and, for significant changes, email account owners at least 15 days before they take effect. If you keep using AirQR after that, you accept the updated terms; if you don't agree, you can cancel before they apply.
